However, a third charge accusing Simpkins of shooting another victim was not granted double jeopardy, and Simpkins will stand trial on that charge. In the motion, Clayton states that following Simpkins' initial conviction, Assistant Criminal District Attorney Rose Anne Salinas"berated the jury expressing her outrage of the sentence term being 12 years."
Clayton writes that he scheduled a meeting last year with Tarrant County District Attorney Phil Sorrells about Salinas' behavior, but Simpkins was indicted on charges of unlawfully carrying a weapon in prohibited places and aggravated assault with a deadly weapon three days later.
