As the calendar flipped over to March, we told you that Dish, in an SEC filing, said that thanks to the large amount of debt it has coming due this year, and the likelihood that it will burn through much of its cash, there is"substantial doubt about ability to continue as a going concern." Dish will not be able to exercise the option it was given by T-Mobile to purchase 13.5MHz of low-band 800MHz spectrum. Not only won't Dish make that deadline, it paid $100 million that it could sorely use right now and got nothing in return. According toCFO Peter Osvaldik, if Dish doesn't exercise the option to buy the 800MHz spectrum on April 1st, and it already has said that it won't,Dish told the SEC that it won't exercise the $3.59 billion option it holds to buy 13.

Osvaldik said,"We haven't commenced that auction yet, but should they choose not to exercise it, that'll be the next step for us."will have to hold such an auction by this fall and it will be up to the FCC to decide who can participate in the bidding. Bothwould naturally have an interest in the spectrum because it is right next to spectrum that they already own. But there is an issue that prevents the two majors from buying the airwaves.

Fierce Wireless says that other firms might be interested in the spectrum including the Burns & McDonnell Engineering Company which could use the spectrum to provide wireless service for electric utilities.
