: So you're probably all aware that facial recognition technology is becoming more widespread and is being used in a variety of applications. Today, we're going to talk about facial recognition technology and how it's being used in law enforcement. Just like a lot of tech solutions to complex problems, facial recognition algorithms are not perfect.
If you look at any of these cases, I think it's easy to see that there is some violation of constitutional rights, and that's of course very serious, and denying people their freedom is definitely really high on the list of some of the most harmful ways that an algorithm can harm a person, but also that violation touched their lives in different ways.
That seems like the sort of thing that if I was a criminal defense attorney, I'd really want to know that and I'd really want to make sure that was something that you could argue about in court, or at least certainly bring, let's say an expert in to challenge, but you can't do that because facial recognition is treated as an investigative tool instead of evidence.
And so that can present some challenges, as well, because misidentification is considered one of the primary issues that leads to wrongful convictions, according to the Innocence Project. And people are also less adept at identifying people from different race groups. So there are different parts of that process of using facial recognition in a criminal investigation that a lot of people who are concerned with it say can present challenges or bias.
